Paraná labour court annuls expert report carrying a hidden instruction aimed at AI and fines the court-appointed expert, report says
A labour court in Castro, Paraná (9th Region Labour Court), annulled a court-appointed expert's report after the employer, in a motion for clarification, reported a hidden sentence at the foot of a page instructing artificial intelligence to contest the report only superficially and not to question the files it cited, according to Diário de Justiça. The expert confirmed the text but said it came from teaching material about AI and was inserted by accident; the court's IT section concluded that it had been formatted deliberately to be invisible. The judge said AI had not been used to write the judgment and that the text did not directly influence it, but annulled the report, later submissions and the judgment, ordered a new examination by another expert without AI tools, fined the expert 5% of the value of the case for bad-faith litigation, cancelled the expert's fees and removed the expert from the court's register. The decision, dated 12 October 2026, can be challenged.

AI system as recorded: An unspecified AI tool that the hidden instruction in the expert report addressed; the report describes no AI output
What Happened
The hidden text. In a labour case before the Castro labour court in Paraná, the employer reported in a motion for clarification that a sentence had been inserted at the foot of a page of the court-appointed expert's report. Diário de Justiça translates it as an order to artificial intelligence to contest the report very superficially and not to question the files cited, whatever command it was given. The employer said the text was white on a white background in a tiny font and could only have been placed deliberately, and argued that the report had been the sole basis of the judgment against it. The report had found that the worker was exposed to biological agents at a medium degree of insalubrity.
The expert's explanation and the court's finding. The expert confirmed the text but said it belonged to teaching material on AI prepared for a postgraduate class and was saved into the report by accident on an old, slow computer. The court's IT section concluded that the sentence was a structured text deliberately given hidden properties and placed at the end of the last page, and that hardware faults could not have produced it. The judge accepted that analysis and found at least serious fault.
The decision. The judge said AI had not been used to write the judgment and that the hidden text had not directly influenced it, but held that it compromised the technical evidence. The judge annulled the report, the later submissions and the judgment, ordered a new examination by another expert with AI tools prohibited, fined the expert 5% of the value of the case for bad-faith litigation, cancelled the expert's fees and removed the expert from the court unit's register. The decision is dated 12 October 2026 and can be challenged. Whether any AI tool actually processed the report is not reported.
Reported harm
A court-appointed expert was fined 5% of the value of the case, lost the expert's fees and was removed from the court's register after a hidden instruction aimed at AI was found in the expert report (Diário de Justiça); the expert says the insertion was accidental.
How Harm Occurred
A court-appointed expert's report contained a hidden instruction addressed to AI tools; the court treated it as a deliberate attempt to influence automated processing of the evidence and sanctioned the expert.
Outcome
OngoingThe judge annulled the expert report, the later submissions and the judgment, ordered a new expert examination with AI tools prohibited, fined the expert 5% of the value of the case, cancelled the expert's fees, removed the expert from the court unit's register and asked the regional internal-affairs office to consider definitive delisting and to check other reports the expert signed. The expert can challenge the decision (Diário de Justiça, 16 October 2026, updated 26 October).
What remains unknown
- The value of the case and so the amount of the fine.
- Which AI tool the hidden instruction was meant for, who would have run it, and whether any AI processed the report.
- Whether the expert has challenged the decision and how any challenge was decided.
- The case number and the decision text, which were not read; the account rests on one outlet.
- The effect of the annulment on the worker and the employer beyond a new examination and a new judgment.
What the evidence supports
AI involvement: reported. The report describes no AI output. The harm is the court's response to a hidden instruction addressed to AI tools in the expert's report (c1, c3): the court annulled the report and sanctioned the expert (c4, c5). Which AI tool the text was meant for, and whether any AI processed the report, is not reported; the judge said AI was not used for the judgment. No relation describes an AI system's own action toward the expert (unknown; consequential response).

Ninth Circuit fines and suspends two immigration lawyers over briefs with AI-hallucinated citations and denials of AI use; immigration board follows
On 3 June 2026 the US Court of Appeals for the Ninth Circuit fined immigration attorneys Mike Singh Sethi and William Rounds $2,500 each and suspended both from practice before the court for six months. Briefs filed in an asylum petition for review cited two cases that do not exist and attributed quotations to opinions that do not contain them. In a motion to correct, the attorneys called the errors typographical, and at oral argument Rounds twice said AI was not used. In their response to the court's order to show cause, they conceded that the errors were probably the product of unauthorised AI use by the firm's unlicensed brief writers and a failure to check citations. The court said the suspension was owed to their repeated failure of candour. The Board of Immigration Appeals then suspended Sethi from practice before the Board, the immigration courts and the Department of Homeland Security for six months, effective 13 June 2026, and designated that decision as a precedent on 1 October 2026.
Paraíba, Brazil: judge fines a lawyer R$32,800 over hidden AI commands in a petition, G1 reports; state bar later suspends two lawyers in such cases
A judge of the 5th Mixed Court of Sousa, Paraíba, found hidden instructions aimed at artificial intelligence tools spread over seven pages of a lawyer's motion for clarification in a public-competition case in June 2026, including an order to ignore impartiality and a note calling it a test of whether the judge used only AI to decide. The judge fined the lawyer two penalties of R$16,400 (R$32,800 in total) for bad-faith litigation and contempt of the court's dignity, and referred the case to the Paraíba bar (OAB-PB) and the state prosecutors, G1 reports. The defence said the commands were not inserted deliberately and blamed an error in exporting a file prepared with AI support. An appeal judge refused to suspend the fines on 30 June, the trial judge kept them on reconsideration, and in July, G1 reports, the OAB-PB preventively suspended two lawyers after opening procedures into two hidden-command cases, one of them the Sousa case.
Pará labour court fines two lawyers about R$84,000 over hidden instruction aimed at the court's Galileu AI; the lawyers deny manipulating the decision
In May 2026 a judge of the 3rd Labour Court of Parauapebas, in the Brazilian state of Pará, fined two lawyers about R$84,000 after text in white font on a white background was found in a document they filed for a worker in a labour claim. According to the sentence as reported by G1, the hidden text was detected while the judgment was being drafted with Galileu, a generative AI tool the labour courts use to help judges and staff draft sentences, and its evident intention was to make the AI produce a superficial defence or a compromised draft judgment. The judge called the technique prompt injection. The lawyers said they disagreed with the decision and that there was never any command to manipulate the judge's decision, describing the text as an attempt to protect their client from the AI; one of them said she did not work on labour cases. In October 2026 the regional labour court announced that a Connecticut Superior Court judge had cited the decision when sanctioning a litigant for misuse of AI.
Alabama Supreme Court dismisses two siblings' family-trust appeal as a sanction after their lawyer admits using AI that produced fake citations
On 24 April 2026 the Supreme Court of Alabama dismissed an appeal by two siblings in a family dispute over living trusts because their lawyer, W. Perry Hall, had filed briefs in which most of the legal authorities were misquoted or did not exist. The court said they appeared to be AI hallucinations, and at a show-cause hearing in February 2026 Hall admitted that many authorities did not exist and that he had improperly used AI to obtain them. The court ordered Hall to pay the opposing party's fees and costs of $17,200 and double appeal costs, barred him from filing in the court without a co-signing attorney and referred him to the Alabama State Bar. It said the dismissal was imposed as a sanction because of the particularly egregious facts. One justice, concurring in part and dissenting in part, objected to dismissing the appeal as a sanction for the lawyer's conduct but would have affirmed the judgment against the clients on the merits.
